Waiver and Release of Liability for Durham Rangers Basketball Club

By completing the registration form, I, the undersigned, as the parent or legal guardian of the minor participant, agree to the following Waiver and Release of Liability for participation in activities organized by Durham Rangers Basketball:

1. Parties

This Waiver and Release of Liability is entered into between Durham Rangers Basketball and the undersigned participant or legal guardian (hereinafter referred to as "Participant" or "Guardian"), collectively referred to as the "Parties."

2. Assumption of Risk

Participant acknowledges that while safety measures will be in place, risks cannot be completely eliminated, and accidents or injuries may occur.
Participant acknowledges and understands that engaging in the Activities involves inherent risks, including but not limited to:

• Physical Risks: Risks associated with physical activity such as sprains, strains, fractures, or injuries.

• Sports-Specific Risks: Risks arising from contact with other participants, equipment, or playing surfaces during sports activities.

• Environmental Risks: Uneven surfaces, equipment malfunctions, or unpredictable circumstances.

• Social Risks: Interactions with other participants that could result in misunderstandings, accidents, or disputes.

• Negligence by Others: Actions or omissions by other participants, agents, or staff that may lead to harm.

Participant acknowledges that while safety measures will be in place, risks cannot be completely eliminated, and accidents or injuries may occur.

3. Release of Liability

I, on behalf of myself, my child, and my heirs, release, waive, and discharge Durham Rangers Basketball, its officers, employees, coaches, volunteers, agents, and affiliates from any and all claims, liabilities, actions, or damages arising from my child's participation in the basketball program, whether caused by the negligence of the Released Parties or otherwise.

I agree not to hold the Released Parties liable for any injury, loss, or damage, including but not limited to bodily injury, emotional distress, property damage, or death that may occur during the program.

4. Medical Treatment

In the event of an injury or medical emergency during my child’s participation, I grant permission for Durham Rangers Basketball and its authorized representatives to seek emergency medical treatment. I acknowledge that I am responsible for any medical costs incurred, including but not limited to doctor’s fees, hospital charges, and insurance co-pays.

5. Insurance

I acknowledge that Durham Rangers Basketball does not provide personal health or accident insurance for my child. It is my responsibility to ensure that my child is covered by a suitable health insurance policy during their participation.

6. Media Release

Participant (including parents) grants Durham Rangers Basketball the right to use their name, image, likeness, or voice in photographs, videos, or other media taken during the activities for promotional, educational, or marketing purposes without compensation.

7. Personal Information

Participant consents to Durham Rangers Basketball collecting and using their personal information for communication and administrative purposes. Durham Rangers Basketball will not sell or share personal information with third parties without consent.

8. Governing Law and Jurisdiction

This Agreement shall be governed by and construed under the laws of Ontario, Canada, and any disputes arising from this Agreement will be resolved exclusively in the courts located in Ontario.

9. Compliance with Rules

I agree to ensure that my child follows all rules, regulations, and guidelines set forth by Durham Rangers Basketball and its coaches, staff, and volunteers. I understand that non-compliance may result in disciplinary actions, including suspension or removal from the program.

10. Indemnification

I agree to indemnify and hold harmless Durham Rangers Basketball and its affiliates from any claims, damages, losses, and expenses (including attorney fees) arising from or related to my child’s participation in the program, including claims brought by third parties for injuries caused by my child.

11. Acknowledgment of Understanding

By signing below, participant acknowledges that they have read this entire Waiver and Release of Liability, fully understand its terms, and voluntarily agree to its content.

Severability Clause
If any portion of this Agreement is found to be invalid or unenforceable, the remaining sections shall remain in full force and effect.
